You are hereby informed that your above referred tender read with subsequent letters mentioned above for the stores specified in the schedules annexed has been accepted, This rate contract will be governed by the terms and conditions brought in the Form No. DGS&D 1001. The Rate Contract and the Schedules annexed hereto shall be the sole repository of this Rate Contract/Transaction.

1.(C) DURATION OF THE RATE CONTRACT:
The rate contract shall remain in force from 09.10.2003 to 16.9.2005. and supply order against the rate contract may be placed till the last date of the currency of contract .
2. TERMS OF DELIVERY:
The prices are For Destination.
3. PRICE:
The applicable prices for the R/C with effect from 09.10.2003.are indicated in ANNEEXURE I for Civil indentor and in Annexure II for paramilitary forces .

7. PAYING AUTHORITY : The Chief Controller of Accounts,
Indentors/Direct Demanding : Department of Commerce, Supply Division,
Officer of Central Govt.
8. INSPECTION
There shall be no inspection of tyres, tubes and flaps. The stores shall be accepted under firms warranty and Guarantee as per R/C The contractor shall ensure that stores Supplied are of the same ply rating and tread patterns as specified in the schedule of R/C.
9. WARRANTY FOR TYRES, TUBES AND FLAPS
i) Tyres, Tubes and flaps supplied by firm against the supply order shall carry a guarantee of 5 years, 3 years and 3 years respectively from the date of manufacture, irrespective of kilometerage against defects which are attributable to defective material design, or faulty workmankship. The guarantee shall not be operative once the tyre is retreaded.
ii) The supplier warrants that the tyres tubes and flaps shall be of fresh manufracture and shall not be older than six months on the date of acceptance of stores by the consignee .
iii) On receipt of any defective report from the user on
pre-manufacture failure of the tyres, tubes and
flaps, joint investigation will be carried out by the representative of
AGD(QA), New Delhi and the firm, either at the site or at a place of ADG(QA)s
choice. In case the defect is attributed to defective material, design, faulty
workmanship the firm shall provide pro-rate compensation/ replacement. The defective stores shall be returned to the
contractor only on receipt of replacement supplies on freight to pay basis. In
case of any dispute, the decision of the ADG(QA),

10. Delivery; Within 30 days from the date of receipt of order delivery promise.
Car tyres: 2000/3000 per month, light truck 500/1000 per month
Truck tyre-2002-3000 per month, Farm tyre -1000/1500 per month

PRICE FREEZE AND PRICE VARIATION:
The Rate Contract prices are based on contractors net basic dealer prices less 5.5% discount for civil and 7% discount for para military forces as per Annexure I and II attached. The prices of the items except s.no.5,8,10.17,18& 42 to 63 are firm and fixed for six months from the date of commencement of R/C i. .e ie.,09.10.2003 .and subject to one price increase every six months thereafter on the basis of revised net Basic dealer prices submitted by the contractor duly certified by their Internal Auditor/Chartered Accountant. For all other items the price are firm and fixed. The effective date of price increase shall be 30 days from the date the request is filed with DGS&D complete in all respects.
Downward revision shall however be applicable from the effective date of such price revision in the market and should be submitted to DGS&D IMMEDIATELY. (Purchaser reserves the right to include new items in the rate contract).
In case of above 27 new items are added to the R/C , the prices would be kept firm for 12 months from the date of commencement of R/C.
PRICE APPLICBILITY:
Prices applicable will be R/C prices as on the date of dispatch of stores.
4. EXCISE DUTY:
The net Dealer price is exclusive of @24% or @16@ as applicable. The current rate of Exise Duty is indicated in enclosed ANNEXURE 1&11. Statutory variation shall be to Purchasers account. Excise duty shall be inclusive of ED as applicable for item No. 1 to 41 & prices are inclusive of ED as applicable for item No,.42 to 63 of Annexure AI & AII
5. SALES TAX:
The sales tax shall be paid extra as applicable. On production documentary evidence.

present rate or CST is @of 4% against Form C/D Local Sales Tax applicable to

11. DIRECT DEMANDING OFFICERS
This rate contract will be operated by the Indentors of the Central Government to be called as the Direct Demanding Officers (DDOS) in addition to the Officers of the DGS&D. There will not be a separate list of DDos specifying particular Ministry/Department or the office of the Central Government contain an undertaking to the effect that the authority placing the supply order is a Central Government/Department /Office.
12. TRANSIT INSURANCE CLAUSE:
The purchaser will not pay separately for transit insurance and the supplier will be responsible till the entire stores contracted for arrive in good condition at destination.
13. Annual Turnover/ Monetary Limit : Without Limit
14. The firms will furnish the Quaterly drawal report in the proforma attached. One copy to AM-3 Section & one copy to MIS for the following dates.
i) 31.12.2003 iv)30.9.2004 vii) 30.6.2005
ii)31.3.2004 v) 31.12.2004 viii) 09.10.2005
iii)30.6.2004 vi) 31.3.2005
In case confirmation of receipt of Drawal Report firm the for is not communicated by the DGS&D by 31.1.2004, 30.4.2004, 31.7.2004, 31.10.2004, 31.1.2005, 30.4.2005, 31.7.2004 & 31.10.2005
for the respective quarters to PAO, the payments shall be with held by PAO.
15. In case any amendment is required for price schedule the firm will furnish the sufficient copies of price schedule for all items duly certified by Internal Auditor/Chartered Accountant and amendment will indicate all the items on the R/C./
